Why the Second Strike in the Caribbean Cannot Be Justified Under Any U.S. or International Law

Every major report on the Caribbean boat incident agrees on one uncontested fact. The second U.S. strike did not hit a vessel that was maneuvering or fighting. It hit survivors who were clinging to the wreckage after the first missile destroyed their boat. They were in the water, incapacitated, and unable to pose a threat to anyone.

Under Article 12 of Geneva Convention II, the U.S. Law of War Manual, Section 7.6, and long-standing customary maritime law, shipwrecked persons are protected. Once a person is in the water and unable to fight, they cannot be attacked. This rule applies even in an active armed conflict. In this case, the United States is not at war with anyone involved. Even if it were, the second strike would still violate the protections granted to the shipwrecked and the incapacitated.

U.S. law reinforces the same principle. The Maritime Drug Law Enforcement Act allows the United States to interdict vessels suspected of trafficking, board them, detain crews, and bring them to trial. It does not authorize the extrajudicial killing of drug traffickers. It does not create a class of people the president can label as “narco-terrorists” and kill without evidence or judicial review. That authority does not exist in domestic law, international law, or the Constitution.

Reports indicate that nearly two hours passed between the first and second strikes. That matters. When a strike leaves survivors in the water, commanders are trained to consider rescue, medical recovery, and whether those survivors still present any danger. Any reasonable chain of command would discuss these questions. A recommendation would move upward until someone with authority gave a final decision. That means the second strike was not a spontaneous battlefield choice. It was a deliberate act taken with time to think about the condition of the people in the water. Someone made the decision that they should not live.

This is why the issue will not disappear. It is not a partisan talking point or a policy disagreement. It is an allegation that the United States carried out an unlawful killing of shipwrecked survivors in a situation where both U.S. and international law prohibit such an action. No amount of political allegiance can override that reality. The seriousness of this incident demands transparency and accountability because the rules that protect the shipwrecked protect our own service members as well. If we abandon them, we weaken the moral and legal protections that Americans have fought to uphold for generations.
